1. Agreement to Terms

These Terms and Conditions ("Terms") govern access to and use of the AppliedMode platform at appliedmode.com and related services (the "Platform"). By creating an account, accessing an institution workspace, or using any part of the Platform, you agree to these Terms on behalf of yourself and, where applicable, the educational institution you represent.

If you do not agree to these Terms, you must not use the Platform.

2. Platform Description

AppliedMode is an institution-first learning management and academic operations platform designed for universities, colleges, and professional training providers. The Platform enables institutions to deliver courses, manage academic programmes, support instructors and students, and operate compliant digital learning environments.

3. Eligibility and Accounts

You must be authorised by your institution to access the Platform. Institution administrators are responsible for provisioning accounts, assigning roles, and ensuring that users meet institutional eligibility requirements.

You are responsible for safeguarding your login credentials and for all activity conducted under your account. Notify your institution administrator and AppliedMode support immediately if you suspect unauthorised access.

4. Institutional Relationship

AppliedMode provides the Platform to institutions under separate commercial or service agreements. Your institution determines which features are enabled, how academic data is used within institutional policies, and which users may access the Platform.

Where these Terms conflict with a written agreement between AppliedMode and your institution, the institutional agreement prevails for that institution's use of the Platform.

5. Acceptable Use

You must use the Platform lawfully, professionally, and in accordance with your institution's academic integrity and conduct policies. Prohibited conduct includes, without limitation:

  • unauthorised access to accounts, data, or systems;
  • distributing malware, conducting disruptive security testing, or attempting to bypass controls without written authorisation;
  • uploading unlawful, defamatory, harassing, or infringing content;
  • academic misconduct, including plagiarism, impersonation, or unauthorised collaboration where prohibited;
  • sending spam or unsolicited communications through Platform tools;
  • interfering with the availability, integrity, or performance of the Platform.

6. Content and Intellectual Property

AppliedMode retains all rights in the Platform, including software, branding, documentation, and underlying technology. Institutions and their authorised users retain ownership of educational materials, course content, assessments, and submissions they upload or create, subject to the licences necessary to operate the Platform.

7. Privacy and Data Protection

Our collection and use of personal information is described in the Privacy Policy and Data Protection Policy. By using the Platform, you acknowledge that personal data will be processed as described in those documents and in accordance with applicable law.

8. Service Availability and Changes

AppliedMode aims to provide reliable, secure service but does not guarantee uninterrupted availability. We may modify, suspend, or discontinue features with reasonable notice where practicable, particularly where changes improve security, compliance, or platform stability.

Planned maintenance windows and material service changes will be communicated through appropriate institutional channels where possible.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis to the extent permitted by law. AppliedMode does not warrant that the Platform will meet every institutional requirement or that all content uploaded by users is accurate, complete, or fit for a particular academic purpose.

Institutions remain responsible for academic decisions, accreditation obligations, and compliance with applicable education regulations.

10. Limitation of Liability

To the fullest extent permitted by law, AppliedMode and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or academic outcomes arising from use of the Platform.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud or wilful misconduct.

11. Suspension and Termination

AppliedMode or your institution may suspend or terminate access where these Terms are breached, where required for security or legal compliance, or where an institutional agreement ends. Upon termination, you must cease using the Platform and respect any applicable data retention or export requirements communicated by your institution.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the version and last updated date shown on this page. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms, unless your institution's agreement provides otherwise.

13. Governing Law

These Terms are governed by the laws applicable to AppliedMode's contracting entity, without regard to conflict-of-law principles. Disputes will be handled in accordance with the dispute resolution provisions of any applicable institutional agreement, or otherwise before the courts of competent jurisdiction.
